<b>Justice Ibrahim Bubba, of the Federal High Court in Lagos, has ordered the National Drug Law Enforcement Agency (NDLEA) to vacate the residence and properties of Senator-elect Buruji Kashamu. </b></div>
<div style="text-align: justify;">

<div style="text-align: justify;">
Mr. Kashamu has been under House Arrest since the early hours of Saturday, when the NDLEA swarmed around his house.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
Mr. Kashamu is currently wanted by the United States on charges of narcotics trafficking. He was incarcerated on similar charges in the United Kingdom, but released before his extradition to the United States.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
The NDLEA issued press statements saying that Mr. Kashamu was placed under House Arrest so that it would be certain that he appear before the court on Monday May 25, for a ruling whether an extradition process to the United States would begin. However, the NDLEA was unable to bring Mr. Kashamu to court on Monday.</div>

Mr. Kashamu's lawyer, Ajibola Oluyede, spoke with <i>SaharaReporters</i> today and said that "the court order is a direct result of the motion I submitted yesterday, telling the court that what the Attorney General and NDLEA were doing was unlawful". The motion stated that the Attorney General, Mr. Adoke, and the Chairman of the NDLEA were in violation of Mr. Kashamu’s human rights.</div>

"We have now issued charges against the Attorney General and the NDLEA for criminal conduct for how they carried themselves", Mr. Oluyede told a <i>SaharaReporters</i> correspondent.</div>

He added: "they must now return to court on June 4th to answer these charges".</div>

<div style="text-align: justify;">
Mr. Oluyede also stated that "it is clear that the original purpose of this invasion was to kidnap him [Mr. Kashamu] and ship him off to the US, in violation of the Extradition Act".</div>

"No arrest warrant was issued by the court, which means they [the Attorney General and NDLEA] never intended to follow legal procedure", he said.</div>

Mr. Oluyede then revealed that he received information that, "their [the NDLEA and Attorney General] first plan was to abduct him on Saturday and ship him off to the US. It was only when this failed that they started talking about taking him to court".</div>

Mr. Oluyede also told <i>SaharaReporters</i> that it is obvious that former President Olusegun Obasanjo was behind the latest efforts to arrest Senator-elect Kashamu. </div>

"Prince Kashamu is the political nemesis of Obasanjo, who has now lost relevance in the South West".</div>

"Obasanjo is now a paper weight electorally in Nigeria, he may have international clout but he cannot get votes for people in Nigeria", Mr. Oluyede said.</div>

The NDLEA Head of Public Affairs, Mr. Ofoyeju Mitchell, told <i>SaharaReporters</i> that "the NDLEA has not received any court order to vacate Mr. Kashamu's residence and we believe any order to vacate his residence is diversionary".</div>

Mr. Mitchell also stated that "the NDLEA refuses to be distracted by his court maneuvers and advises that Kashamu respect the law by submitting himself to the due process of the law".</div>

Mr. Mitchell also stated that it is false to suggest that the NDLEA has acted unlawfully, "we received a provisional warrant from the Federal High Court".</div>

<b>A Federal High Court in Lagos has ordered the more than 50 operatives of the National Drug Law Enforcement Agency (NDLEA) to immediately vacate the Lagos residence of the senator-elect for Ogun East Senatorial District, Mr. Buruji Kashamu.</b></div>

The NDLEA,  whose operatives had laid siege on Kashamu's residence in Lagos since Saturday, said it had received a formal extradition request on Kashamu from the government of the United States of America and was coming to court to secure an extradition order.</div>

<div style="text-align: justify;">
But Justice Ibrahim Buba, in a bench ruling on Tuesday afternoon, pronounced the action of the NDLEA as sub-judice and ordered the men of the Nigerian police to ensure that NDLEA operatives vacate Kashamu's premises "without a free for all".</div>

<b>Senator-elect Buruji Kashamu, who is alleged to have bolted from the United States (US) over drug trafficking charges, has failed to show up at the Federal High Court, Lagos, citing lack of arrest warrant.</b></div>

According to Mitchell Ofoyeju, Head, Public Affairs Division of the National Drug Law Enforcement Agency (NDLEA), Kashamu has failed to submit himself to the laws of a country he intends to represent at the senate.</div>

<div style="text-align: justify;">
“Senator-elect Buruji Kashamu has failed to appear in court from his house, where he is being closely monitored by operatives of the National Drug Law Enforcement Agency (NDLEA),” Ofoyeju said in a statement issued on Monday.</div>

<div style="text-align: justify;">
“The agency is working hard to ensure that he submits himself to the due process of the law. His house remains cordoned by anti-narcotic officers pending his appearance in court.</div>

“The extradition move by the NDLEA for Kashamu to answer drug-trafficking charges is legal. The Agency has not violated his rights and will continue to work within the confines of the law. He has been assured that due process of the law shall be adhered to at every stage.”</div>

The enforcement agency insisted that it would pursue the extradition of the 56-year-old businessman to a logical conclusion.</div>

<b>The National Drug Law Enforcement Agency (NDLEA) has advised the Senator-elect for Ogun-East senatorial district, Mr. Buruji Kashamu, to concentrate his effort on defending himself before the Federal High Court where he is expected to appear on Monday (today).</b></div>

The agency reiterated that the decision to drag him before the court followed a formal request for his extradition by the United States.</div>

Kashamu is the Chairman, Organisastion and Mobilisation Committee of the PDP in the South-West and he was a staunch supporter of President Goodluck Jonathan's re-election bid.</div>

He fell out with former President Olusegun Obasanjo and teamed up with President Goodluck Jonathan during the battle for the control of the party in Ogun State.</div>

The agency said it was wrong of Kashamu to finger Obasanjo and a leader of the PDP in Lagos State, Chief Bode George, as being behind his present travails.</div>

According to the NDLEA, Kashamu had been on the wanted list of both the US Drug Enforcement Administration, and the Immigration and Customs Enforcement of the Department of Homeland Security.</div>

“Kashamu was indicted in the Northern District of Illinois, United States, on charges brought against him by ICE.</div>

“According to the United States court documents, Kashamu in his days as the leader of a prolific heroin-trafficking ring based in Chicago, Illinois, was known as 'god', 'Daddy', and 'Kasmal'. He is wanted to stand trial for charges of conspiracy and importation of controlled substances, namely heroin, into the United States dating back to 1994.</div>

“Kashamu, who holds dual Nigerian/Beninoise citizenship, has taken multiple pre-emptive actions to thwart US extradition efforts such as claiming that he was being mistaken for his deceased brother whom he claimed committed the alleged offences in the US.”</div>

The statement also said that Kashamu had filed injunctions at courts in the Northern District of Illinois, United States, and in Nigeria to prevent his arrest and prosecution.</div>

<b><span style="font-family: inherit;">Armed operatives of the National Drug Law Enforcement Agency (NDLEA) have gained access into the residence of the Senator-elect for Ogun-Eas Senatorial district, Mr Buruji Kashamu, where he has been confined to his bedroom.</span></b></div>

<span style="font-family: inherit;">His lawyer, Ajibola Oluyede, who spoke with <i>The PUNCH</i> correspondent near the residence, on Sunday, said Kashamu had not been allowed to leave his bedroom since Saturday.</span></div>

<span style="font-family: inherit;">Oluyede said: "He has been locked inside the room while about 15 armed operatives are in the house. As I speak to you, I have not even seen him. We have only been talking through the door.</span></div>

<span style="font-family: inherit;">Oluyede alleged that the NDLEA had no plan of taking Kashamu to court on Monday (today) but only later decided to do so because the media got involved.</span></div>

<span style="font-family: inherit;">“Their plan was to get him as early as 4am and put him on the plane to the United States. It was never their plan to take him to court. It was when the media reported the incident that they decided to take him to court", he said.</span></div>

<span style="font-family: inherit;">About 15 patrol vehicles were seen blocking all entries that lead to Kashamu's home while over 20 security agents were seen patrolling the street.</span></div>

<span style="font-family: inherit;">Residents of the estate were made to take alternative routes as all roads leading to Kashamu's home were blocked.</span></div>

<span style="font-family: inherit;">In his reaction, the media aide to Kashamu, Austin Oniyokor, however, berated the drug agency, accusing it of being the mouthpiece of Obasanjo and George.</span></div>

<span style="font-family: inherit;">The statement said: "We do not know when the NDLEA becomes the spokespersons for Chief Olusegun Obasanjo and Chief Bode George. We do not need them to tell us to address our issues.</span></div>

<span style="font-family: inherit;">“We are addressing our issues. We had told the court of the planned abduction of Kashamu and the NDLEA was represented. The court had given an order asking all the parties to stay action, pending the determination of the suit which had been fixed for Wednesday".</span></div>

<span style="font-family: inherit;">Oniyokor explained that Kashamu refused to hand himself over to the NDLEA operatives, who stormed his Lagos residence on Ladipo Street, Lekki Phase 1, on Saturday, because they could not produce a warrant of arrest.</span></div>

<span style="font-family: inherit;">He said if the NDLEA provides a warrant of arrest against Kashamu, the PDP chieftain would "hand himself over to them but if not, he will not".</span></div>

<span style="font-family: inherit;">But a member of PDP Board of Trustees, Chief Ebenezer Babatope, described the allegation by Kashamu that George was behind his travails as sad and ridiculous.</span></div>

<span style="font-family: inherit;">A statement by Babatope on Sunday said: “It is sad and ridiculous of Senator-elect, Chief Buruji Kashamu, to accuse Chief Bode George of being behind his current ordeal with the men of the NDLEA.</span></div>

I have known George for over 46 years and I know him never to go on a witch-hunt of anyone as a result of personal differences or disagreements. A U.S federal grand jury, in 1998, charged Mr. Kashamu and 14 others for their alleged involvement in an international conspiracy to smuggle heroin into America.</div>

Mr. Kashamu said he had “confirmed that this illegality is being designed and executed by Chief Bode George whose wife is the Director General of the NDLEA, all in a bid to score cheap political points.”</div>

Mr. Kashamu urged “all well-meaning Nigerians to prevail on NDLEA, Chief George and his wife to toe the path of the rule of law and follow due processes, Kashamu cried out”.</div>

‘Nigeria is not a Banana republic! The United States (US) being the bastion of democracy, the rule of law and due process should not lend itself to this kind of illegality,” he said.</div>
