<b>Ekiti State Governor, Mr Ayodele Fayose has described outbursts of the All Progressives Congress (APC) over the possible removal of the Independent National Electoral Commission (INEC) Chairman, Prof Attahiru Jega as "mere comedy", saying; "President Goodluck Jonathan can sack Jega if he wishes and if he does, heavens will not fall."</b></div>

The governor, who said the APC should stop acting as if Nigeria belongs to the party, added that: "by turning themselves to advocates and defenders of the INEC chairman, the APC and its agents have shown that they have a deal with Jega to manipulate the elections and that the deal will be frustrated if he is asked to leave office". </div>

Governor Fayose said in a release issued yesterday, and signed by his Special Assistant on Public Communications and New Media, Lere Olayinka, that "removal of Jega and any other appointees of the Federal Government is a prerogative of the president, which no one can question, provided laid down rules are followed."</div>

He said the position expressed by the House of Representatives was that of the APC members in the House, urging that "the APC lawmakers should rather pay attention to the ill-health of their party’s presidential candidate, Major General Mohammadu Buhari (rtd), whose whereabouts is now a mystery."</div>

The governor described Jega as partisan, saying: "By his actions and utterances, Jega had already demonstrated his bias in support of the APC.</div>

"For instance, how can Jega explain the 80 percent distribution of Permanent Voters Card (PVC) in Boko Haram ravaged Borno and Yobe States while less than 40 percent distributed in Lagos as at February 7 that the election was postponed?"</div>

 He said "It is on record that Prof Maurice Iwu was asked to proceed on terminal leave two months to the end of his tenure? Is Jega not a beneficiary of Iwu's removal? So if Iwu was asked to go on terminal leave before the expiration of his tenure for Jega to assume office, what difference does it make if Jega too is asked to proceed on terminal leave before the expiration of his tenure?"</div>

Speaking further, Governor Fayose said: "it is the president that can determine whether or not Jega will go on the mandatory three months terminal leave which should commence on March 8, and if the president decides that the INEC chairman should go on terminal leave, what can the APC loudmouths do?</div>

"They boasted before the postponement of the elections that they would go on street protests, but did they do anything? They made noise when Justice Isa Ayo Salami was removed from office as president of the Court of Appeal, what did their noise amount to? </div>

"Therefore, let me say it categorically that the noise being made by the APC and their agents will amount to nothing because if the president removes Jega today, heavens will not fall."</div>

The APCPCO said in a statement on Wednesday in Abuja that it is not only insulting for Mrs. Jonathan to describe the presidential candidate of APC, General Muhammadu Buhari as “brain-dead” it is also demeaning of her status as the First Lady.</div>

Consequently, President Jonathan is urged to call his wife to order, according to the statement signed by Director of Media and Publicity of APCPCO, Mallam Garba Shehu.</div>

Shehu observed that it was discourteous and inexcusable for a wife of any president with a modicum of decency to make such a false and infantile pronouncement about the health status of another man on account of politics.</div>

The APCPCO recalls that in recent time, Mrs Jonathan has made statements invoking violence like she did in Calabar over the weekend when she urged PDP supporters to “stone” all those canvassing for change.</div>

Shehu said that it was below the standard of a wife of a president to stoop so low to call for violent attacks against members of the opposition.</div>

The statement noted that while a good number of Nigerians are not taken by surprise by Mrs. Jonathan’s recent incredulous pronouncements, it is important for her husband to put her in bridles in the spirit of the Abuja Peace Accord.</div>

The APCPCO similarly observed that much as indecent and disgraceful the outbursts of Mrs. Jonathan was in attempting to pull the wool over the eyes of Nigerians about her husband’s incompetence to lead the country, it is typical of the PDP’s <i>modus operandi</i> to confuse Nigerians with mundane issues instead of the issues of corruption, for which her husband has achieved an unbeaten record; his appalling lack capacity to secure life and property of citizens and a glaring incompetence in dealing with the challenges facing the economy.</div>

Speaking to journalists after the match, Mr. Obasanjo who was the captain of the team expressed satisfaction over the game. He said sports is a necessary exercise for both the old and the young.</div>

Obanikoro had resigned his post as Minister of State for Defence to contest the Lagos governorship primary of the Peoples Democratic Party (PDP). But after losing the ticket to Jimi Agbaje, who would now confront Akinwumi Ambode of the All Progressives Congress (APC) next month, President Goodluck Jonathan re-nominated Obanikoro for a return to the federal executive council. </div>

The senate had slated Wednesday for the screening of Obanikoro and seven others as ministers‎, but midway into the screening session, David Mark, senate president, deferred the process to next week. </div>

It is not clear why the senate took the decision, but sources say it was to douse the tension that had been brewing in the senate over the likely confirmation of Obanikoro as‎ minister. </div>

Some All Progressives Congress (APC) se‎nators had left the upper chamber when it became clear to them that Obanikoro would not come before senate. The senators had vowed to resist the confirmation of Obanikoro as minister. As a senator from 2003 to 2007, Obanikoro, in the tradition of the senate, is expected to take a bow and leave when he appear‎s before the upper chamber, but that may not happen as the APC senators are set against him. </div>

Nevertheless, the Peoples Democratic Party has the majority in the senate; hence Obanikoro's confirmation is expected to sail through, perhaps with a fight. </div>

Akwashiki, the first to appear before the senate, was not grilled. Owing to her status as a former senator, she took a bow and left‎. However, the three other min‎isterial nominees were questioned by senators. </div>

Responding to a question from Abdul Ningi, senate deputy minority leader, on the best curriculum for education in Nigeria, Akise, a professor of education who may likely emerge minister of state for education, stated that the Nigerian education curriculum would be developed to meet the developmental needs of the country. He suggested that the curriculum should be reviewed based on the needs of the country. </div>

Good morning gentlemen and welcome to this press conference.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
It’s just about three weeks to the start of the rescheduled 2015 general elections, and the expectations across the country and outside our borders are very high, just as the tension among Nigerians!</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
The eyes of the world are focused on our country, Nigeria, to organize a free, fair, credible and violence-free election that will not only deepen our democracy but will also show to the world that our leadership position in the West African sub-region and the African continent is not a fluke.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
While we in the All Progressives Congress (APC), and definitely most Nigerians, also expect nothing less than very transparent elections, indications are that those at the helms have grown so desperate that they do not even want the elections to hold. And even if the elections must hold at all, they must be held on their own terms: No PVCs, No Card Readers, No Jega, and the military must be deployed to intimidate voters!</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
These dangerous conditionalities by the ruling party, the PDP, and the Jonathan administration have been playing out publicly, no thanks to the inauspicious comments by elements of the ruling party, who could no longer hide their disdain for credible polls and, indeed, for democracy itself.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
But what has not played out openly are some of the criminal and unlawful actions being secretly hatched by the PDP and the Jonathan administration to rig the forthcoming general elections and perpetuate themselves in power.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
The handwriting is clear: This Administration knows it can never win in a free, fair and credible election because of its appalling record in office. Nigerians want change through the ballot box, and they are determined to effect that change with their PVCs.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
Let me now take you through some of those evil plots being hatched to deny the people of Nigerian their right to vote for change.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
1. There is a plot to transfer a humongous amount of money into the bank account of the INEC Chairman, Prof. Attahiru Jega, and then claim that the money came from Asiwaju Bola Ahmed Tinubu and the APC in order to justify the ongoing plan to sack Prof. Jega so he won’t organize the elections.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
Beyond Jega, there is also a plan to credit the bank accounts of some key national institutions with huge amounts of money purportedly from our party, the APC, ostensibly to compromise those institutions.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
2. There is plan to use some political parties that are satellites of the PDP to push for the postponement of the elections again. The plot is to get the parties to address a press conference to say the elections should not hold in the North-east until Sept. 2015 because of the ongoing counter-insurgency battle there. The intention is to make sure Jega's tenure expires before the polls, so that they can appoint a malleable card-carrying member of the PDP as INEC Chair to conduct the polls.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
3. There is a plan to use the security agencies to intimidate key opposition leaders as well as the Nigerian Communications Commission (NCC) and telecommunications service providers to disrupt voice and data transmission, especially in APC strongholds, on election day.</div>

<div style="text-align: justify;">
As we have said earlier, the telephones of our leaders have been bugged and their movements are being daily monitored.</div>
<div style="text-align: justify;">

It is no longer news that a signal has been sent to all state commands of the DSS to get the list of all INEC Returning Officers and Adhoc Staff before March 10th.</div>

There is also the ongoing illegal recruitment of over 500 new cadets into one of the country’s security outfits, 50% of whom are from the home state of the outfit’s top brass, in violation of the provisions of the Constitution, especially as the recruitment does not reflect the Federal Character.</div>

5. Nocturnal meetings are being held between various heads of national security agencies and the leadership of the PDP to undermine the coming elections;</div>

6. The Presidency has retained the services of two Israelis and a Belgian who are currently holed up in the Aso Rock Villa to hack and corrupt INEC computers on election day, with the trio having already been paid 25 percent of their contract fees upfront.</div>

7. There is an ongoing effort to compromise the card reader, which the Jonathan administration sees as inimical to its rigging plans.</div>

8. Huge funds are being provided for retired and serving security personnel to buy up PVCs, with the hope that they can be used once the card reader is compromised. Remember, gentlemen, that there is a case in court seeking to declare the use of the card reader in the forthcoming elections unconstitutional.</div>

9. In the days leading up to the elections, the Jonathan administration is planning to give the opposition the Ekiti treatment by massively arresting key opposition leaders, with a view to destabilizing their ranks, putting them away and paving the way for a free rein of their rigging agents. Towards this end, thousands of signed blank detention orders have been procured.</div>

10. As part of the plan to implicate our leaders, illegal substances may be put into their checked-in luggage during local and international flights. That is why we are calling on our leaders to travel only with their carry-on baggage.</div>

Let me say that the detailed plans by the desperate Jonathan administration and the PDP are part of the massive intelligence we are receiving daily from patriotic Nigerians, within and outside the government, who are eager to see the organization of free, fair, credible and violence-free elections that will catapult Nigeria to the league of truly democratic nations.</div>

Obasanjo declared that he has confidence in the All Progressives Congress, APC Presidential candidate, General Muhammed Buhari because he was a trained military officer. </div>

<b>Legal experts have told the Presidency the bitter truth about Independent National Electoral Commission (INEC) Chairman Prof. Attahiru Jega - he cannot be sent on terminal leave. </b></div>

There are two reasons for the legal opinion. They are that:</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
•no law or regulation compels political appointees to proceed on terminal leave; and</div>
<div style="text-align: justify;">
•the timing is “inauspicious and not strategic”. </div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
Faced with the legal obstacle, the Presidency may have dumped the option of asking Jega to go on leave. Besides, President Goodluck Jonathan has said although he has the power to remove Jega, the INEC chief has not done anything to warrant his removal. </div>

<div style="text-align: justify;">
A top government official Tuesday said Jega will not be removed or asked to go on leave. But the comment of the supervising Minister of Information, Mr. Edem Duke, has caused disquiet in the cabinet. Some ministers believe that Duke's "inexplicit response to questions on Jega's fate" last Friday has been heating up the polity. </div>

Duke said although the President has no plan to sack Jega, "this is not to say that, if it is time for INEC chairman to naturally exit his office, then the natural course of public service rule will not take place when he has reached the age of retirement or exhausted his tenure."</div>

<div style="text-align: justify;">
According to a source, the legal advice emphatically said "political appointees are not subject to terminal leave".</div>

The source added: "I think we have been having this apprehension on Jega's fate because of the politics which beclouded non-renewal of the tenure of ex-INEC Chairman Prof. Maurice Iwu. I think in managing Iwu's exit, those behind it did not look at the legality of the process in asking him to proceed on leave." </div>

The source also said the Presidency was advised against allowing Jega to go on terminal leave because the "timing of the agitation is inauspicious and non-strategic". </div>

A top government official said: "President Goodluck Jonathan will not remove or ask Jega to proceed on terminal leave. He has told the nation of his position and he will stand by his words." </div>

At INEC, however, a woman National Commissioner is still feeling bad that she was linked to the plot against Jega. </div>

"The National Commissioner has been psychologically disturbed that she is being associated with treachery. Were it not for pressure, she would have addressed the press with some commissioners on why they are standing by Jega", a source said.</div>

Duke's comment is said to have caused disquiet in the cabinet. </div>

"Everyone is disturbed that Edem Duke was not circumspect enough because as a Minister of Information, he ought to know that the press will take note of what is said, intended or unsaid", a source said. </div>

The source added: "No one is happy that the story about Jega has been bordering on alleged plot to remove or ask him to go on terminal leave by the President. We believe as cabinet members, we should also not heat up the polity or create an image crisis for this administration. If you have noticed, the debate on Jega's fate heightened after Duke’s briefing last Friday. </div>

Jega has shelved today's meeting with the 37 Resident Electoral Commissioners (RECs). Instead, the INEC chairman has deployed all National Commissioners and the 37 REC in 12 states for the mock election taking place on Saturday. </div>

<div style="text-align: justify;">
The states selected are: Ekiti and Lagos (South-West); Anambra and Ebonyi (South-East); Delta and Rivers (South-South); Kano and Kebbi (North-West); Bauchi and Taraba (North-East); and, Niger and Nasarawa (North-Central).</div>

The mock election will be used for "field testing of the functionality of the Smart Card Readers".</div>

A National Commissioner said: "All National Commissioners and RECs are going to take part in the mock election which we are using to measure our preparation for the general election. The session between INEC chairman and RECs will now hold next week to enable the commission to consider the report on the mock election." </div>

House of Representatives Speaker Aminu Tambuwal said we cannot play the ostrich with the plot to scuttle the elections. "It is clear that some people are not interested in a free and fair election."</div>

Tambuwal, who spoke when he received a delegation from the Situation Room Advocacy also condemned any move to install an interim government which he said will amount to a coup because it has no place in the constitution. </div>

Also on Tuesday, the House of Representatives sounded a note of warning to President Goodluck Jonathan's administration on the danger of removing the INEC chairman before the general elections. To show its seriousness, they threatened to initiate court action within the country and at the International Criminal Court (ICC), over supposed plots to remove Jega and shift the March 28th and April 11th elections. </div>

The resolution of the House followed the adoption of the prayers of a motion by Hon. Ali Ahmad, Chairman House Committee on Justice. The "Motion on threat to further tamper with the status quo arrangements for the 2015 general elections" was seconded by Hon. Goni Bukar. </div>

The House urged "the political class, government of the federation and of states and security agencies to heed the warning of imminent and present danger associated with any interference with the existing schedules of the general elections".</div>

It said it will "hold personally accountable at domestic judicial forum or at the International Criminal Court any person or organisation that foists on INEC any decision or action whatsoever, including unconstitutional attempt to remove the current INEC chairman, that has the effect of making it impracticable for the elections to hold on 28th March and 11th April, 2015". </div>

Arguing the motion, Ahmad said the initial postponement of the general elections for six weeks due to security concerns related to the Boko Haram insurgency has further heightened the tempo for pre-election violence. He expressed concern on the possibility, threat and insinuation to precipitate actions that would cause further alteration to the status quo arrangement and regulation of the general elections.</div>

Ahmad said: "That such threats to tamper with the status quo may take several forms including, but not limited to, illegal removal of the current INEC Chairman.</div>

"That there is already documented evidence from several sources that any change in status quo arrangements, especially removal of the INEC chairman, presents a possibility of violence and would occasion the sowing of seeds of a major crisis," he said. </div>

The lawmaker said civil society organisations and lawyers, including usually reticent Senior Advocates of Nigeria have sounded "a note of warning" and threatened a "showdown". </div>

According to him, such removal will be unconstitutional, "given the decision of the Supreme Court that removal of the chairman or members of such an independent electoral body as INEC pursuant to S.157 (1) of the Constitution can only be achieved when two things happen, viz: (a) for his inability to discharge the functions of the office, or ( b) for misconduct, as determined by 2/3 majority of the Senate (Governor of Kwara State v. Ojiabor. 2007)."</div>

Ahmad said such deliberately induced violence "may snowball as it did in 2011 post-election period into widespread or systematic attack, persecution, arson, murder, thereby amounting to serious crimes of concern to the international community, as contained in Article 5 of the 1998 Rome Statute of the International Criminal Court, to which Nigeria is a signatory." </div>

However, the Deputy Leader of the House, Leo Ogor, objected to the motion, saying that it was "totally speculative" at best and should not even be entertained, not to mention being passed. His objection was overruled by Speaker Aminu Tambuwal, who called for a voice vote. It was unanimously passed by members.</div>
