Hundreds of Zimbabweans Face Immediate Deportation From South Africa

<b>PRETORIA, SOUTH AFRICA -The immigrant rights group, <i>People Against Suffering, Oppression and Poverty</i> (PASOP) is concerned that hundreds of Zimbabweans are being told to leave South Africa immediately.</b></div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
PASOP is dealing with more than 220 rejections for Zimbabwe Special Dispensation Permits (ZSDPs).</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
The ZSD permit is the successor to a permit issued as part of the Home Affairs Department's Dispensation of Zimbabweans Project (DZP) which was implemented in April 2009. The aim of the DZP was to create a record of Zimbabweans who had, until then, been living illegally in South Africa. It was also intended to give amnesty to Zimbabweans who had been using fraudulent South African identity documents.</div>

<div style="text-align: justify;">
Many of the Zimbabweans living in South Africa had fled the political violence, instability and economic crises that had dogged their home country for more than a decade.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
The ZSDP process began in October last year. <b><i>GroundUp</i> </b>has previously reported on delays and dissatisfaction with the process.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
Bernard Toyambi, who heads a team of paralegals at PASOP, says: "We started receiving rejections in February 2015. The pile of rejections is getting bigger daily. So far we have around 222 rejections."</div>

<div style="text-align: justify;">
According to PASOP, the reasons for rejections include Home Affairs saying applicants have not provided proof of employment or employment contracts, have failed to include their previous permit in their applications or not provided proof of business registration or trade licences.</div>

<div style="text-align: justify;">
In some cases, Home Affairs has picked up that applicants have criminal records. One obscure reason given for a rejection is "negative fingerprint", which PASOP describes as "confusing".</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
At the end of every rejected application letter there is a note: "You are to leave the country within 10 days."</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
"This is worrying," says Toyambi. "Home Affairs gives 10 days without giving them the right to appeal. In terms of the Constitution, everyone has the right to appeal when one feels one is not satisfied with a decision."</div>

<div style="text-align: justify;">
There is additional confusion because a Home Affairs employee, Gerson Muti, apparently told legal representatives of some of the rejected applicants: "Please ignore the rejection letter because all rejections are going to be reviewed even if the person did not lodge the appeal. We are just waiting for our IT section to finish developing the system so that we can start reviewing."</div>

Benhilda Masarirambi is a domestic worker in Cape Town. Her case exemplifies the bureaucratic difficulties applicants are experiencing. Her application was rejected because Home Affairs said she did not have the previous permit. She indeed lost her permit in a car accident. However, she then obtained proof from Home Affairs that she had a permit. <i>GroundUp </i>has seen official documentation that records her permit number. Since receiving the rejection letter, she has been living in perpetual fear of being deported. She is also worried she will lose her job.</div>

PASOP is trying to help the rejected applicants appeal to Home Affairs.</div>

<div style="text-align: justify;">
Toyambi says Home Affairs' review of the rejections could start anytime from next month.</div>

<div style="text-align: justify;">
"We are not very sure how we could assist those whose applications were rejected due to having criminal records. However we still ask them to go for police clearance but if proven guilty we are not in a position to assist."</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
Because of the costs involved in appealing PASOP asks applicants to donate R100 to cover processing (the organisation emphasises this just covers its costs).</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
However, those rejected because of criminal records are asked to pay R200 because of the additional paperwork involved.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
Despite numerous attempts, <i>GroundUp </i>has not been able to get a response from Home Affairs.</div>

Spokesman Mayihlome Tshwete has not responded to our e-mails.</div>

<div style="text-align: justify;">
After several telephone calls an official by the name of Winnie told <i>GroundUp </i>Tshwete was out of the country and that we should e-mail another spokesman, Thabo Mokgola.</div>

We also spoke to him on the phone. He promised a response by 3pm on July 30, but failed to provide one. We also managed to get hold of Gerson Muti but he said he does not speak to the media.</div>

<b>ABUJA, NIGERIA - A former Executive Secretary of the National Health Insurance Scheme (NHIS), Dr. Olufemi Thomas, has surrendered to the Economic and Financial Crimes Commission (EFCC) for interrogation on the alleged seizure of $2.1million cash.</b></div>

The EFCC had threatened to declare him wanted after efforts to locate him both in Lagos and Abuja proved abortive.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
Thomas had denied ownership of the said cash and claimed yesterday that he was never on the run as reported by the media.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
The EFCC is however continuing with its investigation of the matter and may invite a former Minister of Health for questioning on how NHIS paid ₦990million for a plot of land estimated at ₦350million, while Thomas was in office.</div>

<div style="text-align: justify;">
Thomas reportedly arrived Abuja on Thursday night and reported at the EFCC headquarters, Abuja early Friday.</div>
<div style="text-align: justify;">

He was said to have been grilled for several hours by the agency after which his media aide, Mr. Sola Adeyemi, issued a statement describing him as "a law-abiding person, a true professional and a man of his words."</div>

He said: </div>

Today (Friday), we were at the EFCC headquarters in Abuja in reaction to media reports that Dr. Thomas was wanted by the anti-graft agency in connection with a $2.1million cash seizure, where my boss made an official statement on the allegation of money laundering. </blockquote>

This shows that he was never on the run, and he would never do anything against the law of the land. He has gone to answer the EFCC call. So we believe my boss’ visit will put to rest all these allegations and help the anti-graft agency in their further investigation of the matter. Therefore, until the investigation is concluded, we would not speak on this matter.</blockquote>

Adeyemi appealed to the media to "maintain a high level of professionalism in the discharge of your duties in order that the anti-graft agency can focus on a thorough investigation on the various allegations."</div>

According to <b><i>The Nation,</i></b> a reliable source in the commission said the former Executive Secretary of NHIS voluntarily came to the EFCC office for interrogation on the seized cash.</div>

"We have interacted with him and we asked him to make statement accordingly on what he knew about the cash," the source said.</div>

"We also grilled him on the relationship between him and the Bureau de Change operator, Ibiteye John Bamidele, who was <a href="http://nigerianewsroom.blogspot.com/2015/07/man-nabbed-at-lagos-airport-with-fake.html">arrested with the money by the National Drug Law Enforcement Agency </a>(NDLEA).</div>

Betty Kanario was reported by a pre-school boy who saw her unhung the innerwears belonging to their neighbor and started crying hence attracting his mother's attention who thought the boy had fallen from the balcony only to realize he had seen a stranger in the apartment.</div>

She tried to escape with the paper bag she had stuffed the pants after the boy's mother started shouting 'mwizi mwizi'.</div>

Police, DSS Arrest Youth Council Members At Election Venue

<b>ABUJA, NIGERIA - Operatives of Department of State Services (DSS) and the Nigeria Police on Saturday arrested some officials of the National Youth Council of Nigeria (NYCN) at Agura Hotel, Abuja, where election of a new leadership for the association was being held.</b></div>

It was learnt that the arrest was based on a petition by the outgoing president of the council, Henry Nwabueze, alleging that some youths planned to cause a breach of peace in Abuja.</div>

The security men later reinforced and took over the hotel, apparently to frustrate  the election of the new officials of the council.</div>

But the action of the security personnel did not stop the election as NYCN officials, who escaped arrest, relocated to another location where they conducted the poll.</div>

It was learnt that a leading contestant for the council leadership, who eventually emerged as the NYCN president, Ikenga Ugochinyere, and the electoral officers were earlier invited by the FCT Police Command for questioning.</div>

Following the operation by the security agencies, a press conference earlier fixed by the council to present the new leadership was aborted.</div>

Chairman of the Electoral Committee, John Nwakama, who declared Ugochinyere winner of the election, said the era of imposition of candidate on the council was over.</div>

According to him, Ugochinyere  polled a total of 209 from 273 delegates, who were earlier accredited to vote on Thursday, adding that some of the delegates left the venue following police harassment.</div>

<b>LAGOS, NIGERIA - For nine days, Shola (not real name) was in pain. The abdominal pain she endured felt as if a knife got stuck in her, she told Saturday PUNCH.</b></div>

She was scared but she had no choice but to endure the pain since she couldn't imagine telling her parents the unimaginable trauma she had been subjected to that led to the pains she was going through.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
"How could I face them? How could I tell them that the man they handed me over to, to help process my admission, had raped me?" Shola said.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
But then, much as she tried, she couldn't continue hiding her ordeal, especially when the pains had become unbearable. Shola's parents eventually got to know what their daughter had passed through in the quest of trying to become an undergraduate.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
Eighteen-year-old Shola is one of the numerous hopeful candidates, wishing to secure admission into the University of Lagos. But her score of 211 in the Unified Tertiary Matriculation Examination (UTME) fell short of the requirement for Mass Communication, which was her choice.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
Her father, who resided in Abesan Estate in Ipaja area of Lagos, had done all he could to ensure that her daughter would become a university student this year but all his efforts seemed to be futile.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
"Someone told me to send her UTME registration number. He checked on the university website and said she was not eligible. Not convinced, I went to the school myself to check and it was the same problem.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
"I had to start making calls to other universities where she could secure admission and someone told me she could be helped to gain admission into the Olabisi Onabanjo University with that score.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
"As soon as the UTME result was released around May, I informed a friend of mine who lives within the estate, who is a lecturer at UNILAG. I took my daughter to him and he promised that when it was time for the post-UTME examination, he would help her out with the process."</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
The friend Shola's father mentioned is Dr. Akin Baruwa, a lecturer in the Department of Accounting, UNILAG, who is also a chairman of one of the community development committees of Abesan Estate.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
Shola's father explained that when she realised that her result was not being accepted as eligible for Mass Communication, he went back to Baruwa on July 22, 2015 and the lecturer told him to bring his daughter the following morning so he could take her to campus and see how he could help.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
"He said they had to take off very early the following morning. I did not suspect anything unusual about that timing because I trusted him. By 4am, I roused my daughter. We prepared and I took her to Baruwa's house. I did not opt to follow them because I trusted him. I did not imagine that anything untoward could happen," he said.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
Baruwa and Shola took off from Abesan about 5am. She would later return home by 11am. His daughter was noticeably moody as she came home. Two hours earlier, Baruwa had called the father and told him that he had done all he could but that it did not seem her admission would be possible.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
"When he told me that, I believed he had done all he could and told my daughter to come back home," he said.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
But it was not the same Shola that left home that came back. She was moody and noticeably quiet. She went straight to her room and locked the door.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
In company with child rights activist, Mrs. Esther Ogwu, whom the case was reported to by the family, <i><b><a href="http://www.punchng.com/news/why-i-raped-my-friends-teenage-daughter-unilag-lecturer/">Saturday Punch</a> </b></i>correspondent spoke with Shola in private to give details of what actually happened in Baruwa's office that day.</div>

It was obvious the girl was trying hard to stay composed. While she spoke, her right hand would go to her lower abdomen occasionally. When asked about it, she explained that she was still feeling some pain, which had reduced a lot since she got treatment.</div>

<div style="text-align: justify;">
Shola said on Thursday, July 23, 2015, as her father handed her over to the lecturer, she still did not suspect anything until they got to around Maryland.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
"While I was inside the car, he started to touch my hair and rub my head. I was very surprised and I brushed off his hand. He never tried it again till we got to UNILAG," Shola alleged.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
According to her, while they were on the way, Baruwa was showing her different parts of town, telling her about places she did not know.</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
She alleged: </div>
<blockquote class="tr_bq" style="text-align: justify;">
While we were on the way, he asked if I go out at all and I told him I don't usually go out. And he would show me a place and say 'This is Maryland o. You may not know since you don't go out.' Then he took me to the Yaba College of Technology. He drove inside and showed me the place. We later proceeded to UNILAG. </blockquote>
<blockquote class="tr_bq" style="text-align: justify;">
When we got to his office, it was about 6.30am. The offices in the building were deserted. He said he liked to be early to avoid traffic. He told me to sit on the couch in his office. </blockquote>
<blockquote class="tr_bq" style="text-align: justify;">
I noticed he was restless. He would stand and go outside sometimes. He asked if I wanted anything, I told him I was fine. He put on the television; I told him I was okay. He put on the air conditioner and I told him I did not want that. </blockquote>
<blockquote class="tr_bq" style="text-align: justify;">
He had already heated water and made Coffee, which he offered to me. I told him I was okay and really did not need that. He then put the hot Coffee on the table. Later, out of respect, I took the cup and sipped a little. I started to feel drowsy not long after that. I did not know why.</blockquote>

According to Shola's narration, Baruwa later took her to see a female official in another building who examined her documents and explained further that there was little that could be done on her admission.</div>

Baruwa reportedly said she might have to opt for diploma.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
Shola claimed that when they went back to his office, the lecturer kept her document on his table.</div>

<div style="text-align: justify;">
She said:</div>

He kept standing and moving around the office. Later, he went outside and when he came back inside, he locked the door and kept the key on his table. I did not know what was happening. </blockquote>
<blockquote class="tr_bq" style="text-align: justify;">
A moment later, he told me to pick up a paper for him beside the couch. As I bent down to pick up the paper, he pushed me into a corner of the couch and held me down as he forcibly removed my trousers and underwear.</blockquote>
<div style="text-align: justify;">
Our correspondent asked at this point if Shola made any attempt to shout to alert anybody nearby.</div>

She claimed that she actually screamed but that the way he held her down did not allow her voice to be as audible as she had wanted it to be.</div>
<div style="text-align: justify;">

Shola claimed:</div>
<blockquote class="tr_bq" style="text-align: justify;">
If people were around the office, they would have heard me shout. He held me down, and pulled down my trousers and underwear. I screamed and begged him to leave me alone but he did not. </blockquote>
<blockquote class="tr_bq" style="text-align: justify;">
After he had his way, he released me. As soon as I pulled up my trousers, I grabbed the keys to the door and rushed out while he was dressing up. He was walking behind me as I walked downstairs from his office. He said nothing as I walked away crying. He later went back.</blockquote>

Shola's father told our correspondent that he had been able to secure a place for her to write her post-UTME examination for an admission into OOU but the young girl has refused to go.</div>
<div style="text-align: justify;">

When our correspondent asked Shola why she refused to go, she said: "How can I be sure that this same thing would not happen there? I don't know anybody there. If it happens again, where would I run to?"</div>
<div style="text-align: justify;">

Our correspondent tracked down Dr. Baruwa a day after speaking with Shola and he gave his version of the encounter.</div>
<div style="text-align: justify;">

<div style="text-align: justify;">
According to him, he indeed had a sexual encounter with Shola but it was "consensual."</div>
<div style="text-align: justify;">
<br /></div>
<div style="text-align: justify;">
The lecturer, who seemed to be in his early 40s, told our correspondent that he made the mistake of not doing enough to resist the temptation of 'sleeping' with Shola.</div>
<div style="text-align: justify;">

Speaking with our correspondent in the front of his house out of earshot of his wife and two children, Dr. Baruwa said: </div>
<blockquote class="tr_bq" style="text-align: justify;">
I swear to God that the girl agreed to everything that happened. She was a chatty girl, who did not show any shyness. </blockquote>
<blockquote class="tr_bq" style="text-align: justify;">
It is true that I took her to YABATECH and showed her places. What is not true is that I deliberately took off from home because of any plan to do anything bad to her. I took off from home that early to avoid traffic. </blockquote>
<blockquote class="tr_bq" style="text-align: justify;">
When she was in my office, she was the one telling me to be free with her. I realised that I needed to lie down a little and did not want my shirt to be rumpled. When I pulled it off, she even told me not to mind her presence that since it was my office, I could do whatever I wanted. </blockquote>
<blockquote class="tr_bq" style="text-align: justify;">
When we first got to the office, she lay on my chest and was even playing with my manhood. That was why I could not resist it. After we came back from seeing the woman who was supposed to help with her admission, she was about to go when I told her to give me a hug. It was that which now led to the actual sexual encounter. </blockquote>
<blockquote class="tr_bq" style="text-align: justify;">
When I realised that I could not resist her, I had to tell her to let me put on a condom. The truth is that, while I was putting on a condom, she stood by and waited. I did not actually penetrate. When she was saying "it's enough, it's enough" and complaining that her tummy had started hurting her, I stopped.</blockquote>
<div style="text-align: justify;">
Baruwa explained that Shola's father had sent a cryptic text message to him (days later when he learnt of what happened to his daughter), saying that he had learnt of what he did to his daughter.</div>
<div style="text-align: justify;">

"I know I betrayed his trust but nobody would understand it was consensual. I would have reached out to him to beg him if I think it would solve the problem," he said.</div>

When told that Shola went through more than a week of excruciating abdominal pain, Baruwa explained that if Shola left him the day of the encounter with any sign of hurt, he would have reached out to her to find out how she was doing.</div>

Two days after our correspondent spoke with Baruwa, he was arrested by the police and the case is being investigated at the Isokoko Police Division, Agege, Lagos.</div>

The case has also been reported at the Office of the Public Defender under the Lagos State Ministry of Justice. The Director of the OPD, Mrs. Omotola Rotimi, said the case would be followed to its logical conclusion.</div>

Director of the Esther Child Rights Foundation, Esther Ogwu, a social worker handling the case, said when the case was first reported to her, the health of the girl was her immediate concern.</div>

I believe this lecturer had been doing this in the past. It is necessary for girls to be aware and know what to do when in a potentially dangerous situation where they may be assaulted. </blockquote>

I don't expect him (the lecturer) to admit that he raped her. I knew he would say it was consensual, but I suspect that this is not the first time he would do such thing. Let the law take its course because we don't know how many other girls are being saved because this case is coming out to the public.</blockquote>

Baruwa was arraigned before an Ikeja Magistrate's Court, Lagos on Thursday. He has been remanded at the Kirikiri Prison.</div>

The 29-year-old mum of one who is believed to be originally from Zimbabwe and is now selling sex in Hillbrow in Joburg, South Africa said since that day she has experienced nothing but pain.</b></div>

Last Sunday night things reached a low point for her when her clients gave her a beating instead of paying her for her services. Her face was so swollen she could barely see and her teeth were loose.</div>

"I was approached by a guy who wanted me for the night. I got into his car and there was a second man sitting there. They gave me some booze and I sat back and relaxed, but soon we were in an area that made me nervous," she said.</div>

At that point the men said they wanted her to service them both.</div>

"I said I had only agreed to have sex with one man. If they wanted more, they had to give me an extra R300. They got angry and said they were not going to be bossed around by a prostitute. They then forced themselves on me. When I tried to scream they kicked and beat me. I thought I was going to die. However, they stopped after a while and took me back to where they had picked me up," she said.</div>

She said blood was streaming down her face as she was walking home.</div>

<b>KAZAN, RUSSIA - Tiny 10-year-old Alzain Tareq, the world championships' youngest competitor in Kazan, swam her personal best to finish third in her 50m freestyle heat on Saturday.</b></div>

The Bahrain schoolgirl had caused a splash at the Kazan pool on Friday morning when she raced in the women's 50m butterfly heats and finished last of the event's 64 competitors.</div>

She is believed to be the youngest swimmer to have ever swum at a world championships.</div>
<div style="text-align: justify;">

She was back in the pool on Saturday to finish third in her 50m freestyle heat and was 105th overall of the event's 113 racers with a new PB of 35.78 seconds - nearly three seconds faster than her qualifying time.</div>

She was more than 11 seconds slower than Cate Campbell of Australia's fastest qualifying time.</div>

<div style="text-align: justify;">
But the pint-sized Bahraini is just happy to have met her idols like Missy Franklin of the USA and Sweden's butterfly world champion Sarah Sjostrom having now swum both of her events in Kazan.</div>

"I didn't get the time I wanted, but I still beat my personal best, so I am happy," beamed Tareq.</div>

She was clearly proud of her newly-acquired bright pink race suit and said a highlight of her Kazan trip had been warming down in the same lane as Franklin on Friday.</div>

Her presence here has sparked plenty of attention from fellow competitors and the media.</div>

"A few other swimmers spoke to me after my race yesterday, they were taking pictures and wishing me good luck," she said.</div>

Tareq was delighted to have met Franklin, Sjostrom, plus Australian sisters Bronte and Cate Campbell who took gold and bronze respectively in Friday night's 100m freestyle final.</div>

"I have their pictures in my phone, but when I get home I am going to print them all out, so I have them," Tareq said.</div>

It is unlikely Tareq will fulfil her wish to swim at next year's Olympic Games in Rio de Janeiro, even though there are no age restrictions to competing at either a world championships or an Olympics.</div>

She qualified for Kazan as the Bahrain's fastest female swimmer.</div>

But to swim in Rio she will need to lower her 50m freestyle personal best of 35.78 to meet the Olympic's minimum qualifying time of 26.17 secs to race in her strongest event.</div>

<b>Netwerk24</b> reported on Tuesday that the boy and his stepfather were arguing when the stepfather apparently threatened to shoot him.</div>

The cause of the argument is unknown, but no gun was found in the home, according to Free State police.</div>

The boy's mother was at their Fichardt Park, Bloemfontein, home at the time of the incident, and cradled her dying husband, <i>Netwerk24 </i>reported.</div>

A neighbour said the teenager was in a state after the stabbing, and hovered over his stepfather, repeatedly urging him not to die.</div>
